PART I

TERMS AND CONDITIONS

Article 1 - Introductory provisions

1.1 These terms and conditions govern the legal relationship between BRICOL s.r.o. (hereinafter referred to as the "Organiser" or "Seller") and the purchaser of the tickets (hereinafter referred to as the "Customer").

1.2 The subject of the contract is the sale of electronic tickets for one-off cultural, social, sporting or other events organised under the Ranch 13 brand.

1.3 Tickets are sold at a price range of approximately 5 - 100 EUR depending on the specific event.

Article 2 - Contract conclusion

2.1 The Contract is formed upon successful payment of the order through the Comgate payment gateway.

2.2 Payment is due immediately.

2.3 The tax receipt is sent electronically.

2.4 The Organiser is not responsible for:

  • incorrectly entered data,
  • technical problems on the customer's side,
  • spam filters of e-mail boxes.

Article 3 - Ticket Delivery

3.1 The ticket is delivered electronically (PDF/QR code).

3.2 Each ticket is unique and valid for one use only.

3.3 In case of duplicate use, the first code retrieval is decisive.

Article 4 - Portability and prohibition of resale

4.1 Tickets are transferable.

4.2 They may not be resold commercially without the consent of the Organiser.

4.3 The Organiser reserves the right to cancel a ticket acquired illegally.

Article 5 - Withdrawal

In accordance with Section 19(1)(k) of Act No. 108/2024 Coll. it is not possible to withdraw from the contract without giving a reason.

Article 6 - Cancellation, change of term, force majeure

6.1 In case of cancellation of the event, the full price will be refunded within 14 days.

6.2 For rescheduling, the customer may request a refund within 7 days.

6.3 The organiser is not responsible for cancellations caused by force majeure, in particular:

  • extreme weather,
  • natural disasters,
  • interference by public authorities,
  • security threats,
  • pandemics,
  • technical failures beyond the control of the organiser.

Article 7 - Safety and Conduct

7.1 The visitor is obliged to follow the instructions of the organiser.

7.2 The following is prohibited:

  • bringing dangerous objects,
  • intoxicating substances,
  • aggressive behaviour.

    • 7.3 The organiser may expel a person without refund.

    Article 8 - Site Risks and Liability

    8.1 Events are held in an outdoor venue.

    8.2 The visitor acknowledges the risks associated with:

  • uneven terrain,
  • movement of animals,
  • weather conditions.

    • 8.3 Participation is at your own risk.

    8.4 The organiser is not liable for injuries unless caused by gross negligence.

    Article 9 - Parking

    9.1 Parking is at the visitor's own risk.

    9.2 The organiser is not responsible for damage or theft of vehicles.

    Article 10 - Photography and video recording

    10.1 Photographs and video recordings may be taken during the event.

    10.2 By attending the event, the visitor acknowledges that they may be captured on video footage.

    10.3 The footage may be used for marketing purposes by the Organiser.

    PART II

    CONDITIONS

    • Tickets are non-refundable.
    • Refundable only upon cancellation of the event.
    • Change of dates - refund possible within 7 days.
    • Tickets are transferable.

    PART III

    RECLAMATION SCHEDULE

    Reclamation may be made for:

    • non-delivery of the ticket,
    • technical error,
    • incorrect data.

    Claims must include identifying information and order number.

    Performance within 30 days.

    1. Scope of processed data

    We process:

    • first and last name,
    • email,
    • phone,
    • billing details,
    • IP address,
    • cookies,
    • order details.
    1. Purpose of processing
    • performance of the contract,
    • legal accounting obligations (10 years),
    • marketing (based on consent),
    • analytics (Google Analytics),
    • marketing tools (Meta Pixel).
    1. Data transfer outside the EU

    Some providers (Google, Meta) may transfer data outside the EU based on standard contractual clauses.

    Web uses:

    • necessary cookies,
    • analytical cookies,
    • marketing cookies.

    The user gives consent via the cookie bar.

    1. Rights of the data subject

    You have the right to:

    • to access,
    • correction,
    • deletion,
    • restriction,
    • portability,
    • file a complaint with the Office for Personal Data Protection of the Slovak Republic.

    Out-of-court dispute resolution

    The Parties shall attempt to resolve all disputes out of court in order to maintain good business relations. In the event of failure to do so, the Parties agree that all disputes arising between them arising out of or in connection with legal relationships created by these Terms and Conditions or the concluded Contract, including disputes concerning validity, interpretation and termination, as well as disputes arising out of other legal relationships created prior to the signing of the Contract, shall be settled before the General Arbitration Court of the Slovak Republic, Dunajská 8, 811 08 Bratislava, IČO: 37 814 681 (hereinafter referred to as the "Court of Arbitration") by a sole arbitrator in accordance with the internal rules of the Court of Arbitration. The Parties hereby agree to add the jurisdiction of the Arbitral Tribunal to the previous legal relations between the Parties. The arbitrator shall be nominated and appointed by the arbitral tribunal. The decision of the arbitral tribunal shall be final and binding on the parties. The parties expressly agree on the possibility of the court within the meaning of Section 22a(1) of Act No. 244/2002 Coll., on Arbitration.
